What is Education Law?

Parents today face tremendous challenges when it comes to their child’s education. Although awareness of disabilities has grown, parents are finding it more difficult than ever to obtain the services that their children need from their school. When parents feel that they cannot make headway with their school administration, it is helpful to enlist the services of an Attorney experienced in Education Law.

Special Education: Under Education Law, students with disabilities have the right to an appropriate educational placement and an educational plan designed specifically for their individual needs. In addition, a School District may not discriminate against a student with a disability. I represent students at CSE Meetings and Impartial Hearings to ensure that they receive the maximum educational benefit that they are entitled to under the law. Children who are not classified as special education students may be entitled to accommodations in school to provide them with equal access to education. I represent students at 504 Meetings and 504 Impartial Hearings to ensure that these students receive the accommodations that they are entitled to.

In School Disciplinary proceedings I represent students who are facing suspension, expulsion or other types of disciplinary penalties. School Disciplinary hearings are very similar to a trial in a court but are held at the school. As with a trial in court I represent students to ensure that their rights are protected.

Other types of matters include parents asserting a refusal to have their child vaccinated, residency determinations to determine whether a family is a legal resident of a particular school district and school transportation issues.
